These Terms of Service govern your use of this website and the coaching application process operated by Summit Coaching. By using this site or submitting an application, you agree to these terms. If you do not agree, please do not use the site.

1. Who we are

Summit Coaching is a 1-on-1 online fitness coaching business operated by Gavin O'Brien as a sole proprietor, based in Sherwood Park, Alberta, Canada.

2. Using this site

You agree to use this site lawfully and not to attempt to disrupt it, gain unauthorised access to it, or copy its content for commercial use without permission. All text, images, video, and branding on this site belong to Summit Coaching unless stated otherwise.

3. Applications and eligibility

Submitting an application does not create a coaching relationship and does not guarantee that you will be accepted. We review each application and may decline anyone for any lawful reason. You agree that the information you provide is accurate and that you are at least 18 years old, or have the consent of a parent or guardian.

4. Coaching services

If you are accepted, the specific services, duration, and price of your coaching are set out in the separate agreement or invoice you receive at that time. That agreement governs the coaching relationship. These terms govern the website and application process.

Any results, testimonials, or transformations shown on this site are individual outcomes achieved by real clients. They are not a promise or guarantee of what you will achieve. Results depend on your starting point, consistency, adherence, genetics, and circumstances.

7. Guarantee

Where a specific guarantee is offered, such as continued coaching at no additional cost if agreed targets are not met, the exact conditions of that guarantee are set out in your coaching agreement. The guarantee requires that you followed the program as prescribed and completed the required check-ins.

8. Payment and refunds

Coaching fees, payment schedules, and any refund terms are set out in your coaching agreement before you pay. Instalment plans, where offered, are billed automatically on the schedule agreed at signup. You are responsible for keeping a valid payment method on file for the duration of any plan.

9. Communications and messaging

By submitting an application you agree that we may contact you by email, phone, and text message about your application, your scheduled call, and your coaching. Message and data rates may apply, and message frequency varies. Reply STOP to any text message to opt out, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages. Details of how we handle your information, including our SMS practices, are in our Privacy Policy.

10. Third party services

This site links to and relies on third party services, including our form, scheduling, CRM, messaging, and payment providers. Their own terms and privacy policies apply to their services. We are not responsible for the content or practices of third party websites we link to.

11. Limitation of liability

To the fullest extent permitted by law, Summit Coaching is not liable for any indirect, incidental, or consequential loss arising from your use of this site or our services. Nothing in these terms limits liability that cannot be limited by law.

12. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last revised. Continuing to use the site after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there.
